LifeTango.com is owned and operated by Vita Qualitas, LLC (which means “Quality
Life” in Latin). LifeTango.com and Vita Qualitas, LLC offer its services
to you subject to the following conditions. Individuals who view pages on LifeTango.com
(i.e., Visitors) or register for a free account (i.e., Members, or at times
also potentially referred to as Users or Customers) accept these conditions.
Individuals who do not agree with the following Terms of Use should leave the
LifeTango.com Website and discontinue use of LifeTango.com Services immediately.
If you wish to browse the LifeTango.com website, or become a Member, communicate
with other Members, and make use of the LifeTango.com Services, you must read
this Agreement and indicate your acceptance during Sign Up.
MODIFICATIONS TO THIS AGREEMENT
LifeTango.com reserves the right to modify this Agreement. Any modifications
shall be effective immediately upon posting to the LifeTango website. All Visitors
to the LifeTango.com website and all LifeTango Members agree to be bound to
any changes to this Agreement when they use the LifeTango Services after any
such modification is posted.
OTHER POLICIES
In addition to these Terms of Use, Visitors and Members should review our other
policies (such as the Privacy Policy and any other policies that are posted
in the future). These policies also govern your visit to LifeTango.com. If any
of these conditions shall be deemed invalid, void, or for any reason unenforceable,
that condition shall be deemed severable and shall not affect the validity and
enforceability of any remaining condition.
LIFETANGO.COM MEMBERSHIPS
A Member of LifeTango.com is someone who registers to use the service. If you
have become a LifeTango.com Member, you are responsible for keeping your log-in
information confidential and you accept responsibility for any activity that
occurs under your account.
ELECTRONIC COMMUNICATIONS
The primary form of communication that LifeTango.com has with its Members and
Visitors is electronic communication in the form of email and site messages.
By visiting or using the site, you agree to receive communications electronically.
All communications that LifeTango.com provides to you electronically satisfies
any legal requirements for written communication.
CONTENT DEFINITION
Content on the LifeTango.com site includes anything posted to the site, whether
by LifeTango.com/Vita Qualitas, LLC, by Visitors, by Members, by LifeTango Partners,
or by any other individual or party. If it is visible when view a page on LifeTango.com,
it is deemed to be “content” of the site. This includes, but is
not limited to the following information posted by Members: Goal Titles, Goal
Descriptions, Start Date, Due Date, Progress, Goal Category, Share Level, Milestones,
Goal Comments, Goal Updates, Comments post on blog entries, and more.
COPYRIGHT
All content on LifeTango.com is copyrighted and the property of LifeTango.com/Vita
Qualitas, LLC or its content providers and protected by copyright laws in the
United States and internationally.
CONTENT GUIDELINES, GOVERNANCE AND REMOVAL
LifeTango.com has the right but not the obligation to monitor and remove any
activity or content. LifeTango.com takes no responsibility and assumes no liability
for any content posted by you or any third party.
At its discretion, LifeTango.com may remove any item of Content from the LifeTango.com
website or change the Share Level of the Content to “Friends and Family”
or “Private” so that only the Member who posted the content, and
possibly Friends and Family who the Member invited to see the content can see
it. Types of content that LifeTango is more likely to remove are the following.
However, LifeTango.com may remove any content for any reason. The following
list is simply provided as a courtesy to its Members to help Members understand
what types of content LifeTango is most likely to remove:
• Any content that appears to have a commercial purpose (i.e., to sell
a visitor or member a product or service or engage them in a business relationship).
• Any content that includes information on contests, sweepstakes, barter,
advertising, or pyramid schemes
• Any content that includes a URL or a partial URL to another website
(especially websites that are business oriented or commercial in nature; greater
lenience is provided for URLs that direct members to sites that are clearly
personal in nature).
• Any content that includes a photograph of another person posted without
that person's consent.
• Any content that attempts to impersonate another individual or party.
• Any content that is offensive in nature.
• Any content that includes profanity or other derogatory language.
• Any content that includes “adult oriented” content, sexually
explicit terms, or nudity.
• Any content that is copyrighted by another individual.
• Any content that expresses hatred or harm against other individuals,
groups, or entities.
• Any content that harasses another.
• Any content that exploits others in a violent or sexual manner
• Any content that contains violence or offensive subject matter
• Any content that promotes false, misleading, or libelous information.
• Any content that involves the transmission or sending of "junk
mail," "chain letters," or other unsolicited mass mailings.
It is also expressly forbidden for visitors, users, or members to include content
that, while not directly violating the conditions above, promotes, recommends
or suggests that others do the same.
COPYRIGHTED MATERIAL
You agree that you will not post copyrighted material created by others and
to which you do not own the rights to publish or post on the LifeTango.com site.
You maintain full liability for any content which you post and agree that LifeTango.com
/ Vita Qualitas LLC is not liable for those postings. Additionally, if a lawsuit
arises based on the posting of content that you post or publish, and if LifeTango.com
/ Vita Qualitas, LLC is included in the lawsuit, you agree to pay all legal
fees incurred by LifeTango.com/Vita Qualitas, LLC to defend such lawsuit. You
represent and warrant that you own or otherwise control all of the rights to
the content that you post; that the content is accurate; that use of the content
you supply does not violate this site’s policies; and that you will indemnify
LifeTango.com/Vita Qualitas, LLC or its affiliates for all claims resulting
from content you supply.
LifeTango.com is not liable for content posted by Visitors or Members, but
will make its best efforts to remove inappropriately posted copyrighted material
when it is informed of such postings and can verify that the content posted
is in fact copyrighted by other parties or individuals. If you are the copyright
owner of material or an interested party and you feel that copyrighted material
has inappropriately been posted to LifeTango.com, send email to privacy@lifetango.com.
Provide as much information and support as possible.
MEMBER-TO-MEMBER COMMUNICATIONS
Members have the ability to leave Comments for other members, or to send other
Members email messages. (Example: “Mary” has posted a goal. “Jim”
wants to send Mary an email message. When viewing Mary’s goal, Jim sees
a link to send a message to Mary. LifeTango does not make Mary’s email
address visible to Jim, but Jim can write an email message using a form on the
LifeTango.com site, and LifeTango will deliver that email message to Mary.)
Comments posted to the site and emails sent through the site may not include
business proposals, sales propositions, “junk” email or “spam”
transmissions, “chain letter” transmissions, etc. Additionally,
any communications sent via the site must adhere to the Content Guidelines posted
above. If two Members choose to share their email addresses with one another
(or Instant Messaging addresses, or phone numbers, or any other methods of contacting
one another), and those two Members then continue conversations through those
methods but not via the LifeTango.com site, then LifeTango has no oversight
or control over those communications and is not liable for any harm or activity
resulting from those conversations.
LICENSE AND SITE ACCESS
You agree that you will not attempt to use all of the site or a portion thereof
commercially or to resell content on the site. You agree that you will not replicate
or reproduce the site or a portion thereof without the written consent of LifeTango.com.
You agree that you will not host the LifeTango.com site or a portion thereof
in a frame on your own website without written consent. You may not use any
meta tags or any other “hidden text” utilizing LifeTango’s
name or trademarks to direct search traffic or mislead another individual or
automated script or search engine service to direct traffic intended for LifeTango.com
away from LifeTango.com to another site without the written consent of LifeTango.com.
DISCLAIMERS
LifeTango.com takes no responsibility for third party advertisements which are
posted on the LifeTango.com Website, nor does it take any responsibility for
the goods or services provided by its advertisers.
LifeTango.com is not responsible for the conduct, whether online or offline,
of any user, visitor, or member of the LifeTango.com Services. LifeTango.com
assumes no responsibility for any interruption, deletion, delay in operation
or transmission, communications line failure, theft or destruction or unauthorized
access to, or alteration of, any visitor, user, browser, or member information
or communication. This site is provided by LifeTango.com/Vita Qualitas, LLC
on an “as is” basis. You expressly agree that your use of this site
is at your sole risk. LifeTango.com does not warrant that this site, its servers,
or e-mail sent from LifeTango.com are free of viruses or other harmful components.
LifeTango.com will not be liable for any damages of any kind arising from the
use of this site, including, but not limited to direct, indirect, incidental,
punitive, and consequential damages.
APPLICABLE LAW
By visiting LifeTango.com, you agree that the laws of the state of Washington,
without regard to principles of conflict of laws, will govern these Terms of
Use and any dispute of any sort that might arise between you and LifeTango.com
or its affiliates.

ACCOUNTS
“Accounts” or “Memberships” are free of charge and provided
at the discretion of LifeTango.com. LifeTango.com reserves the right to remove
any accounts and/or prohibit an individual or entity from creating a new account
in the future. Reasons LifeTango may remove an account and/or prohibit future
creation of additional accounts include but are not limited to repeated attempts
to violate these Terms of Use; attempts to use automatic scripts, bots or other
automated measures to create accounts, create goals, post comments, and/or send
email messages via the site; etc.
